A serious injury in New York comes with a second job you never applied for: managing a claim. Medical appointments, insurance paperwork, an adjuster who calls at the wrong times with the right questions, bills that arrive faster than answers. Meanwhile the party responsible — a driver, a contractor, a building owner — has an insurance company whose entire business is paying as little as possible, as late as possible.

Jimenez Mazzitelli Mordes is a trial firm with offices in Manhattan, Miami, and Houston. Our New York injury team represents people hurt in the five boroughs and beyond — in English or Spanish, directly with the attorneys handling the case, never through a translator. Injury cases are handled on contingency: the consultation is free, and there is no fee unless we win.

Injury Cases We Handle in New York

  • Car accidents — collisions involving cars, taxis, rideshares, delivery vehicles, cyclists, and pedestrians, including claims against uninsured and underinsured drivers.
  • Construction accidents — falls from heights, scaffold and ladder accidents, falling objects, and site injuries. New York law gives injured construction workers protections that exist almost nowhere else, and these cases often involve claims well beyond workers’ compensation.
  • Premises liability — injuries from hazards a property owner allowed to exist: broken stairs, unshoveled ice, inadequate lighting or security, defective sidewalks and building conditions.
  • Wrongful death — holding the responsible party fully accountable when negligence costs a family a life.

How We Approach Injury Cases

We work backward from trial. From the first week, the file is built to be shown to a jury: evidence preserved before it disappears, injuries documented by treating physicians rather than described in adjuster shorthand, witnesses locked in while memories are fresh. Most cases settle — but they settle on terms set by how ready each side is for the alternative. An insurer negotiates differently with a firm it knows will pick a jury.

You also get something simpler: a named attorney who knows your file and returns your calls, in whichever language you think in.

What It Costs to Hire Us

Injury cases are contingency-fee. No retainer, no hourly bills, no fee at all unless we recover for you. The initial consultation is free, at our Broadway office or by phone or video.

FAQs

I was injured on a construction site. Am I limited to workers’ comp? Often not. Depending on who controlled the site and what went wrong, New York law may allow claims against owners, general contractors, and others — separate from workers’ compensation. It costs nothing to have us look.

What if I was partly at fault? New York allows recovery even when the injured person shares some fault, with the amount adjusted accordingly. Do not let an adjuster convince you that partial fault means no case.

Do I have to come to your office? No. Consultations and most of the case can be handled by phone or video, in English or Spanish. If you are hospitalized or immobile, we make it work around you.

How long will my case take? It depends on the injuries and whether the insurer is realistic. What we will not do is trade the value of your case for a fast close — and we tell you honestly, at each stage, what the timeline looks like.
